Please read the terms and conditions carefully before booking on to a training course. When booking with Bywater, you agree with the following:

1.    Payment

Payment must be made at least 30 days before the course starts (or immediately if the start date is closer). Payments are accepted in pounds sterling and can be made by:

  • BACS: Account details are provided on your invoice. Use your invoice number as a reference.
  • Debit/credit card: Business cards incur a 1.75% fee. We accept Mastercard, Visa, Maestro, and JCB (American Express not accepted).
  • Cheque: Payable to Bywater Training Limited. Include your invoice and send it to: The Accounts Department, Bywater Training Limited, Couchmore House, Littleworth Road, Esher, Surrey, KT10 9TN.

Bywater reserves the right to refuse attendance on a course where payment has not been received.

For In-company training, our fees cover travel (where applicable), materials, and trainer expenses unless otherwise stated. If course customisation is requested, fees for this work will be agreed and clearly specified. If cancelled after content development, the associated costs will be invoiced.

For bookings with accommodation, we cover bed and breakfast for the intervening nights of the course. Delegates are responsible for any additional hotel charges (e.g., extra meals, bar, or premium Wi-Fi).

2.    Cancellations, transfers and substitutions

To cancel or transfer a booking, notify us in writing by email. Cancellations or transfers onto an alternative date are free of charge when made 13 or more working days before the original course start date. After that, refunds or credits are not available.

If you need to substitute one delegate for another on a course, let us know in writing as soon as possible. This is free of charge.

Bywater reserves the right to cancel a course at any time, in which case we’ll offer a new date, a credit, or a refund.

3.    Intellectual property

Course materials are copyrighted and owned by Bywater Training Limited. Unauthorised distribution or reproduction is not permitted, and courses must not be recorded without prior written consent.

4.    Health and safety

During training, both Bywater representatives and course delegates are expected to comply with relevant health and safety legislation and site-specific guidelines. Please review these additional points:

  • Personal responsibility: Delegates are responsible for ensuring their own safety and are expected to act with caution and respect towards other attendees, the tutor, and the training environment.
  • Emergency procedures: Emergency exits and procedures will be clearly explained at the start of each course. Delegates should familiarise themselves with these procedures and cooperate fully with any instructions given by Bywater representatives or venue staff in the event of an emergency.
  • First aid & medical needs: First aid provisions are available at all training locations. If you have any medical conditions or specific health needs, please inform us prior to the course so that we can make necessary arrangements to support your well-being.
  • Reporting issues: If you identify any potential health or safety hazards during the course, please report them immediately to a Bywater representative.

Bywater reserves the right to take action, including removing individuals from a course without a refund, where health and safety regulations or guidelines are not followed.

5.    Behaviour

We expect all delegates to conduct themselves respectfully. In cases of disruptive or inappropriate behaviour, Bywater reserves the right to ask individuals to leave, without a refund. Any damage caused to the venue will be the responsibility of the individual.

For virtual classroom training, we ask delegates to keep their cameras on and stay in a quiet, distraction-free environment. Delegates are responsible for having a stable internet connection, which is essential to avoid disruption.

6.    Force majeure

Bywater is not liable for delays or disruptions caused by events beyond our control, such as natural disasters, war, strikes, accidents, or other force majeure events.

7.    Limitations of liability

Bywater provides training and consultancy services and resources intended for informational purposes only. While we strive to ensure that the information and training materials we offer are accurate and up to date, we reserve the right to adjust agendas, trainers, fees, or venues as necessary. We make no guarantees or representations regarding the completeness, reliability, or suitability of the information contained herein.

Any reliance on the materials provided by Bywater is at your own risk. Bywater shall not be responsible for any actions taken based on the information provided, nor for any errors or omissions in the content.

In no event shall Bywater, its employees, associates, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of our services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.

Bywater’s total aggregate liability in contract, tort, misrepresentation, restitution or otherwise, arising in connection with the training shall be limited to the total charges paid for the training.

This limitation of liability applies to the fullest extent permitted by law. If you are dissatisfied with any portion of our services or with any of these terms, your sole and exclusive remedy is to discontinue using our services.

8.    Privacy policy

Bywater is committed to protecting your privacy and handling your personal data responsibly, in line with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR). Bywater Training Limited is a data controller and processes personal data only for the purposes necessary to deliver our services and comply with legal obligations in accordance with our Privacy Policy.

Bywater collects minimal personal data relevant to your training needs, which may include your name, job title, contact details, payment information, and any specific accessibility or dietary requirements. This information helps us provide a safe and effective learning experience tailored to your needs.

Data security & retention

We employ appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction. Your personal information is retained only as long as necessary to fulfil the purpose it was collected for and as required by law. For example, we retain financial transaction records for accounting purposes, and training records to support your professional certifications.

Bywater does not share your personal data with third parties except as necessary to fulfil the services provided (e.g., informing professional and vocational bodies who have approved Bywater as a provider of authorised training, sharing dietary needs with a venue’s catering team or processing payments with secure, compliant providers). In such cases, we ensure that third parties also adhere to GDPR standards.

We do not sell or trade your personal data.

  • Access the personal data we hold about you
  • Correct any errors or incomplete information
  • Erase your data (right to be forgotten), subject to legal requirements
  • Restrict processing under certain circumstances
  • Data portability, allowing you to receive a copy in a structured format
  • Object to processing in specific cases, such as for marketing (though we don’t currently process data for marketing purposes)
  • Withdraw consent where processing is based on consent
